These Terms of Service ("Terms") govern your access to and use of the Goodside mobile application (the "App"), website, and any related services (collectively, the "Services") provided by GoodSide LLC, a limited liability company organized under the laws of Maryland, United States ("we," "us," or "our").

By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services (or the minimum age required in your country). If you are under 18 (or the age of majority in your jurisdiction), you must have your parent or legal guardian's consent to use the Services.

2. License to Use the Services

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use, subject to these Terms. You may not modify, reverse-engineer, decompile, or create derivative works from the Services.

3. User Accounts and Subscriptions

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

The Services include a free tier with limited features and a premium subscription for full access (e.g., unlimited history, advanced insights).
Subscriptions are managed via Apple App Store or Google Play.
Payments are non-refundable except as required by law.
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.

4. User Content and Photo Uploads

You retain ownership of photos and selfies you upload ("User Content").
By uploading User Content, you grant us a worldwide, royalty-free, irrevocable license to process, analyze, store, and use it as necessary to provide the Services (e.g., AI facial geometry analysis, best angle detection, photo ranking, face shape/color/symmetry insights).
Much processing occurs on-device for privacy, but some may involve secure cloud transmission.
You represent that you have rights to upload User Content and that it does not violate third-party rights.
We may delete or refuse User Content that violates these Terms.

5. Biometric and Sensitive Data

The Services use AI to analyze facial geometry, landmarks, poses, expressions, symmetry, and other features from your photos. This may involve processing biometric data (e.g., facial scans or templates).
We process this data solely to provide personalized features like Best Angle Analysis, Best Photo Picker, Face Shape Detection, Color Palette, and Symmetry Score.
We do not sell biometric data or use it for unrelated purposes (e.g., advertising or identification beyond the Services).
Data is handled in accordance with our Privacy Policy, which details collection, storage, retention, and deletion.

6. User Conduct and Prohibited Activities

You agree not to:

Upload content that is illegal, harmful, offensive, or infringing.
Use the Services to harm others or violate laws.
Attempt to interfere with the Services (e.g., hacking, viruses).
Use automated tools to access or extract data.
Misrepresent results or use features for commercial purposes without permission.

We may suspend or terminate your account for violations.

7. Not Medical or Professional Advice

The Services provide aesthetic insights based on AI analysis and research (e.g., facial aesthetics, photography science). They are for entertainment and personal improvement only and are not medical, psychological, or professional advice. Results are estimates and not guarantees.

8. Intellectual Property

The Services, including AI models, code, design, and content (excluding your User Content), are owned by us or our licensors. "Goodside," "Stop Guessing. Start Stunning.," and related marks are our trademarks.

9. Privacy

Your privacy is critical. Our Privacy Policy explains how we collect, use, share, and protect data, including photos, facial analysis results, and device information. By using the Services, you consent to these practices. We prioritize on-device processing and do not share facial data unnecessarily.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind. We do not guarantee accuracy of analyses, uninterrupted access, or that results will meet your expectations. AI outputs may vary.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the last 12 months (or $50 if none).

12. Termination

We may terminate or suspend your access at any time, with or without notice, for any reason (e.g., violations). Upon termination, you must cease using the Services, and we may delete your data per our Privacy Policy.

13. Changes to Terms

We may update these Terms. We will notify you of material changes (e.g., via app notification or email). Continued use after changes constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Maryland.
